These Terms of Service (“Terms”) govern your access to and use of Trivi, an online trivia hosting service operated by Warp Whistle LLC, doing business as Trivi (“Trivi,” “we,” “us,” or “our”). The service is referred to collectively as the “Service.”

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Eligibility and Use of the Service

The Service is provided as a free, invite-only beta. You may use the Service for lawful purposes in connection with hosting and managing trivia events. We may modify, suspend, or discontinue any part of the Service at any time without notice.

We make no guarantees regarding availability, uptime, feature completeness, or data retention during the beta period.

2. Accounts and Access

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. We reserve the right to suspend or terminate access to the Service at any time, including for misuse, abuse, or violation of these Terms.

3. Intellectual Property

The Service and all related software, designs, text, and content (excluding content you submit) are owned by Trivi or its licensors and are protected by intellectual property laws.

You retain ownership of content you create or submit through the Service. By using the Service, you grant Trivi a non-exclusive, royalty-free license to use, host, and display such content solely for the purpose of operating and improving the Service.

4. Disclaimer

The Service is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, Trivi disclaims all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

5. Limitation of Liability

To the fullest extent permitted by law, Trivi and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or business, arising out of or related to your use of the Service.

6. Changes to These Terms

We may update these Terms from time to time. Continued use of the Service after changes become effective constitutes acceptance of the revised Terms.

7. Governing Law

These Terms are governed by the laws of the State of Illinois, without regard to conflict of law principles.
